Publishing Agreement

Publishing and/or Marketing Agreement



This publishing and/or marketing agreement outlines the roles and responsibilities expected of WordHouse as a publisher and endorser and its ‘author-client’ vis-à-vis the publication and/or marketing of a book title. The definition of terms in this agreement will be used to reference several stages in the conduct of work to come up with the ‘output’. The ‘output’ here is defined as the published title of the Author-Client.

Whereas, the Author-Client agrees to pay in full, the amount [amount] to accredit and endorse [book title] with Project ID Number WH-PID******, and shall adhere to the guidelines underlined in this working agreement.

Whereas, WordHouse shall publish and market, conduct profile-raising efforts that may include but not limit to query letters, professional book reviews, print and online ads, bookstore certifications, linkage drops, radio interviews, etc. to display author-client’s book(s) in sales outlets that may include but not limit to journals, libraries, bookstores, online platforms, e-publications, etc. based on the campaign platform specifically designed and prepared for the Author-Client.


Originality

The Author-Client maintains that he/she did not copy/claim the work or any part thereof from any person or party with existing copyrights or mention/claim an invention with existing patents held by others, or discretion over the work otherwise risk debarment from this partnership.


Ownership

The author-client reserves 100% of all the rights and licenses to the ‘output’. Other properties by WordHouse including the company logo, partner names, and properties and trademarks shall be relinquished should the author vote to terminate this agreement.


Fulfillment

WordHouse shall employ the services of various professionals not limited to graphic designers, illustrators, publicists, social media managers, etc. to publish and promote the output. The Author-Client shall settle to WordHouse the costs of these services described in a separate invoice. All promotional activities for the publication of the Author-Client’s book shall commence immediately upon receipt of this Working Agreement duly signed by the Author-Client. Nonetheless, WordHouse shall not fulfill/complete any publication or marketing, unless the amount specified herein is fully accomplished by the partner Author-Client.


Royalties, Book Sales and Work Framework

WordHouse performs its functions with the help of industry partners that includes other publishers, marketers, distributors, bookstores, and vendors and employs industry-approved publishing designs and marketing concepts to aid in its promotional activities and endorsements.

We make no warranties or promises however as to the sum of book sales that may result from any or all of the marketing initiatives that will be part of the Author-Client’s campaign platform.

The Author-Client earns 100% royalties for each book sold after the printing and distribution cost is distributed through Ingram, Amazon, Barnes and Noble, and other online bookstores and partner resellers.


Refunds/Termination

The author will be entitled to a full refund less a $150 administrative fee or 10% of the total purchase price (Administrative/Processing Fee), whichever is higher if the company committed any breach in the contract.

Nonetheless, a 50% refund of the total paid amount less a $150 administrative fee or 10% of the total purchase price (Administrative/Processing Fee), whichever is higher, will be issued should an author cancel after the signing of this agreement or when cancellation occurs before the start of the fulfillment of publication or marketing service(s).

More than 60 calendar days after the purchase: No Refund

After we begin the fulfillment of individual Service(s) or printing of copies: No Refund


NOTE: Fulfillment of a Service occurs either when You return the author questionnaire, whether or not completed fully or correctly, or when We or a Contractor begin work on the Service, whichever occurs first.

Should changes or termination of this contract be necessary because of any request on either party or violation on the Author-Client’s part, a ten-day advance written notice shall be provided by the company or concerned party prior to any official change in the draft or legal termination of this contract.

Disclaimer: Author-clients below the legal age of 18 are required a parent or a guardian’s co-signature to be affixed in the space provided.
